The H-1B visa is a nonimmigrant visa category designed for foreign workers with specialized skills or expertise to work in the United States. The H-1B program helps U.S. employers fill critical positions when they cannot find qualified American workers.
Eligibility Requirements
To qualify for an H-1B visa, both the applicant and the U.S. employer must meet specific requirements:
Job Offer: The applicant must have a bona fide job offer from a U.S. employer for a specialty occupation. A specialty occupation typically requires a bachelor's degree or higher in a specific field.
Educational Credentials: The applicant must possess the necessary academic credentials or equivalent work experience to perform the job successfully.
Labor Condition Application (LCA): The U.S. employer must obtain an approved LCA from the Department of Labor, attesting to the terms and conditions of the employment, including the prevailing wage for the position.
Petition by Employer: The U.S. employer must file a Form I-129, Petition for a Nonimmigrant Worker, on behalf of the H-1B applicant.
Cap Limitations: There is an annual cap on the number of new H-1B visas issued. As of my last knowledge update in September 2021, the regular cap is 65,000, with an additional 20,000 visas available for applicants with advanced degrees from U.S. institutions.
The Application Process
The H-1B application process involves several steps:
Labor Condition Application (LCA): Before filing the H-1B petition, the U.S. employer must submit an LCA to the Department of Labor. This includes details about the job, wage, and working conditions.
Form I-129 Petition: The U.S. employer files Form I-129 with USCIS and the approved LCA and supporting documentation. This form is used to request H-1B status on behalf of the beneficiary (the foreign worker).
Selection in the H-1B Lottery: If the number of H-1B petitions exceeds the annual cap, USCIS conducts a lottery to select the petitions that will be processed randomly.
Adjudication and Approval: USCIS reviews the petition and, if approved, issues an H-1B approval notice (Form I-797). The beneficiary can then apply for an H-1B visa at a U.S. consulate or embassy if they are outside the United States.
Change of Status or Consular Processing: If the beneficiary is already in the U.S., they may request a status change to H-1B. Those outside the U.S. must attend a visa interview at a U.S. consulate or embassy.
Important Considerations
Duration: H-1B visas are typically issued for an initial three years, with the possibility of extension for another three years, for a maximum of six years.
Dual Intent: H-1B visa holders can have "dual intent," meaning they can apply for lawful permanent residency (a green card) while on an H-1B visa without jeopardizing their nonimmigrant status.
Dependents: H-1B visa holders can bring their spouse and unmarried children under 21 to the U.S. on H-4 visas. Spouses on H-4 visas can obtain work authorization in certain circumstances.
Employer Obligations: Employers must comply with wage requirements, working conditions, and other obligations outlined in the LCA.
